While I don't believe there's a chance in hell of any legal action, I don't believe there's anything in the terms and conditions that cover the things that go on in this game.
People pay money for packs, a gamble if you will.
If a bookmaker was to take bets and then be found to alter the outcome of said bet, however small, they would be vilified and likely prosecuted.
This is the best legal argument. However, in a lot of jurisdictions there is no law that ties digital "loot boxes" to the gambling laws. There are movements to try and do that, but they are slow at best. EA is fighting this with all they have. Imagine going to Las Vegas and having the craps table move after you throw the dice to control if you win or lose in order to get you to gamble more. That is FIFA.
The analogy that EA likes to use is that FIFA packs are no different than opening a pack of baseball cards. Except that the contents of the packs are dynamically generated based upon a number of dependent variables. That is like determining what the contents of the baseball card pack would be based upon who is opening it. If that is not what they are doing, and it was near pure chance like a baseball card pack, then they would be able to publish the exact fixed odds for the packing of every single player. They can't, they can only simulate it.
